By accessing, browsing, or using the Website and our online puja services (the “Services”), you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions and our Privacy Policy. If you do not agree to these terms, you must not use our Website or Services.

2. Nature of Services and Limitation of Affiliation

   2.1. Unaffiliated Status

   CLOUD-TEK is a technology-based service provider and is NOT officially affiliated, endorsed, or sponsored by any specific temples, religious institutions, Tirth Shetras (pilgrimage sites), or any government or religious bodies. Any references to temples or Tirth Shetras on the Website are purely for the purpose of identifying the location where the contracted service is to be performed.

   2.2. CLOUD-TEK’s Role as a Facilitator

   CLOUD-TEK’s role is strictly limited to that of a facilitator between you (the “Devotee”) and independent priests/purohits (the “Purohits”). We provide an online platform to book, schedule, and pay for remote puja and religious services. We are responsible for coordinating the service booking and ensuring the Purohit receives the necessary details and payment for the task, susequently we arrange for logistics for shipment of prasadam(if opted for).

   2.3. Independent Contractor Status of Purohits

   The Purohits performing the services are independent contractors who are contracted by CLOUD-TEK on a task-to-task basis to fulfill the specific puja service booked by you. They are NOT employees, agents, partners, or joint ventures of CLOUD-TEK. CLOUD-TEK is not responsible for the conduct, actions, or specific religious rituals performed by the Purohits, except for the coordination of the booking and payment.

3. Eligibility and Scope of Service

   3.1. Intended Use

   The Services offered on the Website are intended exclusively for Devotees who cannot be physically present at the puja site for religious, geographical, or other reasons. By using our Services, you affirm that you are booking the service for a genuine religious purpose and are unable to attend in person.

   3.2. User Eligibility

   You must be at least 18 years of age and capable of entering into a legally binding contract under Indian law to use the Services.

4. Disclaimer on Religious Outcomes (Act of Faith)

   You acknowledge and understand that Puja, Havan, Yagna, and other such religious activities are fundamentally acts of faith, prayer, and devotion.

   CLOUD-TEK offers NO GUARANTEES, explicit or implied, that any desired objectives, spiritual, material, or otherwise, will be met as a result of engaging in the booked religious service. The efficacy, outcome, or realization of the devotee’s wishes rests solely on individual faith and divine will. The fee paid is only for the facilitation and physical performance of the ritual by the contracted Purohit.

5. Payment, Cancellations, and Refunds

   5.1. Payment

   All payments must be made in advance through the payment gateway provided on the Website. Prices for services are subject to change without prior notice.

   5.2. Cancellations and Refunds

   Cancellations may be permitted under a specific policy detailed on the Website (Cancellation and Refunds), requiring a minimum advance notice. Once a service has been scheduled and preparation/procurement for the ritual has begun (which may be immediately upon booking), the payment is non-refundable.

6. Intellectual Property Rights and Website Use

   6.1. Ownership

   The Website, its content, design, service marks, and proprietary software are the exclusive property of CLOUD-TEK and are protected by Indian and international copyright and trademark laws.

   6.2. Prohibited Conduct

   You agree not to use the Website for any unlawful purpose, including but not limited to hacking, introduction of viruses, or attempting to breach the security of the Website.

7. Indemnification and Liability

   7.1. Indemnity Clause

   You agree to indemnify, defend, and hold harmless CLOUD-TEK, its owner, agents, and independent contractors (Purohits) from and against any and all claims, liabilities, damages, losses, costs, and expenses, including reasonable legal fees, arising out of or in connection with:

   1. Your use of the Services or the Website.
   2. Any disputes, disagreements, or issues arising between you (the Devotee) and any contracted Purohit concerning the performance, quality, or outcome of the booked ritual service.
   3. Your breach of these Terms and Conditions.
   4. Your violation of any applicable law or the rights of a third party.

   7.2. Limitation of Liability

   In no event shall CLOUD-TEK be liable for any indirect, incidental, special, or consequential damages arising out of the use of or inability to use the Services. CLOUD-TEK’s total liability for any claim shall not exceed the amount paid by the Devotee for the specific service that is the subject of the dispute.

8. Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in relation to these terms shall be subject to the exclusive jurisdiction of the competent courts in Deoghar, Jharkhand, India.
